Workshops on MSHA litigation scheduled for March
December 23, 2008An alternative case resolution workshop, “Understanding MSHA Litigation,” will be held March 11-13 in Hershey, Pa., and March 16-18 in Albany, N.Y. This workshop will provide mine operators and their representatives with the skills necessary to participate in the Alternative Case Resolution Initiative (ACRI) process without outside legal representation. MSHA’s ACRI conference officers have received in-depth training in dispute resolution and negotiation skills, as well as information necessary to handle contested matters before administrative law judges. To level the playing field when faced with ACRI-trained MSHA personnel, Mark Savit and Brian Hendrix, experienced mining industry attorneys with the Washington, D.C.-based firm Patton Boggs LLP, will provide critical information on organizing and presenting legal arguments, understanding basic principles of MSHA law, legal research techniques and procedures to be followed during litigation. Employees who are responsible for their company’s legal issues or liability, directly involved with safety and health management or participate in MSHA conferences are encouraged to attend this workshop. Participants will receive a manual with form pleadings useful in preparing for settlement conferences and administrative law judge proceedings. Registration is $625 per person.
